4. What Types of Information We Collect & Why

  • Provided Information: Whenever you purchase products and services from us or contact us for other reasons, you voluntarily provide us with information that we collect. Such information may include your name, address, phone number, email address (information pertinent to processing an order or service request) or may be incidentally recorded such as your IP address or gender. By contacting us, for whatever reason, you are consenting to your information being collected, stored, used, and disclosed.
  • Information Acquired Through Use of Our Services: We may also collect information pertaining to how and when you use our websites, products, or utilize our spiritual services. Such information may include your IP address and type of browser used to content and statistics acquired during the provision of a spiritual service.
  • Use of Cookies: We utilize a standard technology called "cookies." A "cookie" contains code that collects information particular to the using of a website — information such as the times, dates, and duration of any visits to our site, what type of browser is used, what pages are accessed while on our site, as well as other similar data. This information allows us to gather statistics in regard to our site and how it is used. Cookies are also designed to help determine if a particular user has visited a site previously so that any preferences may be remembered and retrieved. We may use cookies to keep track of information about your current web browsing session which will be discarded as soon as you log out or close your web browser. We may also make use of "persistent or memory based" cookies, which remain on your computer's hard drive until you delete them. You can always turn the ability to receive our cookies off. This can be done by following the instructions for doing so that are particular to your browser. However, please be aware that after the ability to accept cookies is turned off, our site as well as others, may no longer work properly for you.

5. What We Do Not Collect

We do not go out of our way to collect information on you. Some companies may purchase additional personal information about you from third party resources, but we do not. They may also glean additional personal information about you from your participation in social media sites; however, we do not. Even if your information is publicly available, we will not make an effort to collect it. If we do not need it to process an order, provide a service or it is otherwise provided to us through your interaction with our company, we do not make an attempt to collect it.

6. How We Use & Disclose Your Personal Information

  • Store Marketing & Promotions
The personal information you leave when you visit our site or purchase our products or services may be used to sell you additional products or services. For example, we may send you information regarding sales, new products, contests or other promotions. You can always let us know that you are no longer interested in receiving such information by contacting us and letting us know your wishes.
  • To Bill & Collect Money Owed to Us
Examples of this would include sending you emails, invoices, receipts, and alerting you if we need a different credit card number. We use third parties for secure credit card transaction processing, and we send billing information to those third parties to process your orders and credit card payments.
  • To Send You Alerts & Issue Notifications
For example, we may send you information about planned site outages, permanent changes to our services, new site features, security breaches or store policy changes.
  • To Provide Customer Support
For example, we may email you instructions for taking a spiritual bath in connection with a product or service you have purchased.
  • To Protect the Rights & Safety of Our Customers and Affiliates, As Well As Our Own
For example, we may let you know about some political action that would change what we are allowed to sell.
  • To Meet Legal, Financial or Security Requirements
For example, to comply with court orders or valid subpoenas. This also includes supplying information to legal representatives or other advisors such as lawyers, accountants, and security professionals. Furthermore, your personal information may also be required in the event of any litigation, arbitration or similar law proceeding.
  • To Provide Informational Updates About Your Account
For example, we may let you know that there was an issue with your account and it was suspended.
  • To Transfer Your Information
This instance is only applicable in the unlikely event of a company sale, merger, consolidation or acquisition. However, in that rare event, the company acquiring said information will be held to the obligations we have already established in the Privacy Notice.
  • To Send You Content You Have Elected to Receive
Items such as newsletters and events of interest flyers would be good examples of elected content. You can stop receiving such promotional emails by following the unsubscribe instructions included in every email.

7. Additional Disclosures Relating To Your Personal Information & Privacy

  • We will never divulge to others (unless legally required to do so) the nature of your personal beliefs and practices, nor will we ever judge you for them.
  • Despite the fact that we will always do our best to keep your matters of a personal concern in strictest confidence, please be aware that we have a lawful obligation to report illegal activities, threats to others, and threats to yourself, in the event that such information is somehow disclosed in the course of doing business. Therefore, we ask that you DO NOT divulge such information to us if you do not want it reported.

8. Confidentiality of Electronic Transmissions

Any information sent to Black Cat Curios through this website, our blog, or via other electronic means, shall NOT be considered confidential. We have no way of controlling or ensuring the protection of said information; therefore, we will not guarantee the confidentiality of such transmissions because it is beyond our ability to do so.

9. Content Release

If you post content or submit material to Black Cat Curios, you grant Black Cat Curios a non-exclusive, royalty-free, irrevocable, perpetual, worldwide, and fully sublicensable right to use, reproduce, disclose, exhibit, display, adapt, publish, perform, modify, transmit, transform, translate, create derivative works from, and distribute to others without limitation and in any media or format, said content and materials. You grant Black Cat Curios and any sublicensees the right to use the name that you submit in connection with such content, if they so choose. Black Cat Curios takes no responsibility and assumes no liability for any content submitted by you or any third party. Please know that this content release does not apply to any of your personal information as previously stated in this Privacy Notice.

10. Data Accuracy, Transparency & Your Right to Choose

We do our best to keep your data accurate and up to date, to the extent that you provide us with the information we need to do that. If, for some reason, your data changes (for example, you change your cell number), then you are responsible for notifying us of those changes. Often, our ability to disseminate important information to you is hampered by our lack of current and accurate information. Please help us help you by notifying us as such informational changes occur.

We only store your personal information for as long as it is reasonably required to fulfill the purposes that gave us the right to use it in the first place (like fulfilling orders or providing services). We keep other data, on an as-needed basis, to meet certain PCI Compliance requirements and to aid us in our marketing purposes.

At any time you may request a disclosure of all data that we have collected on you. Since we do not collect or purchase information about our customers from others sources, what you receive will most likely only be that which you have provided directly to us. However, in the event that you do make such a request, we ask that you allow us 14 days to provide you with that information.

Also, unless for some reason we are not legally allowed to do so, upon your request, we will remove from our databases any of your personal information you would like. Again, we just ask that you allow us 14 days to comply with your request.

11. Information Safeguards

No company is immune to the efforts of hackers. We protect your personal information by employing reasonable security safeguards against loss or theft, as well as unauthorized use, disclosure, copying, use or modification. Some of these attempts to safeguard your information include instituting stringent vendor processing requirements and implementing various site and account security measures.

To protect your information, our credit card processing vendor uses the latest 256-bit Secure Socket Layer (SSL) technology for secure transactions and also participates in credit company sponsored security initiatives. Furthermore, due to the way our processor handles transactions, we at no time have access to your credit card information unless, for some reason, you expressly choose to share that information with us.

We also utilize a 256-bit Secure Socket Layer (SSL) site certificate to encrypt the pages served from this site and our blog, as well as implementing other more advanced technological measures. In addition, all of our customer and commenter accounts require a username and password to log in. Because the information associated with these accounts is so sensitive, account passwords are encrypted. Therefore, we do not know what your passwords are, which means we can only reset your password in the event that it is forgotten.

12. Notice of Breach of Security

If a security breach causes an unauthorized intrusion into our system that materially affects you, your customer or commenter account, or other accounts, then Black Cat Curios will notify you of said breach as soon as possible. Once the issue has been resolved and further information is available, we will get back to you and report the action we took in response to said breach, along with any additional instructions that may be helpful.

13. How You Can Help Us Protect Your Information

We ask that you please keep your account usernames and passwords secure, not share your account information with others, and only assign to your accounts passwords that have not been used on another site/for another account. Also, please remember to sign out of your Black Cat Curios customer or commenter account and close your browser window when you have finished placing your order, commenting, or reviewing your account. This is to help ensure that others cannot use your personal information or view your personal correspondence in the event that others have access to your computer.

Ultimately, you are responsible for maintaining the confidentiality of your usernames and passwords and for restricting access to your computer. By using our website, blog, and/or creating an account with us, you agree to accept responsibility for all activities that originate from your computer that effect our site or effect other users of our site, as well as agree to accept responsibility for all activities that occur under/while utilizing your account/s.

Please be aware that we will never ask you for your password in an unsolicited phone call or in an unsolicited email. In very rare cases, we may ask for your password to help us troubleshoot account function issues; however, that contact should not be initiated by us. Any request for assistance with an account issue has to be initiated by you; we will not call you and ask for your account information. A good rule of thumb is, if you did not initiate the request for assistance (in whatever form that takes), then anyone asking for your account information or any other information is suspect.

We ask that you contact us and verify the legitimacy of any suspicious phone calls, emails or letters that appear to have been made by, or sent from, us. We would rather be contacted a thousand times about an innocent email than have a customer fall prey to some type of scam. We urge you to take the time to learn about the various ways hackers and scammers utilize phone calls, emails, the postal service, and other opportunities to use and abuse your personal information.

Lastly, we ask that you let us know of any contact information changes so that, should the need arise, we can quickly make you aware of any security-related events. Often, the impact of such events can be eliminated or reduced the sooner such information is known.

14. Indemnification

You agree to indemnify, defend, hold harmless and blameless Black Cat Curios and its owners, affiliates, vendors, suppliers, other associated parties and their respective employees, officers, directors, agents, volunteers, servants and representatives of each from any liability, loss, claim, suit, damage, and expense (including reasonable attorneys' fees and expenses) related to or resulting from, (i) your violation of this Privacy Notice, and the Service Agreement as a whole, or (ii) your purchase and/or use of any of our products or services or the use of this website. This indemnification is given on behalf of yourself and your next of kin, heirs, representatives or other interested parties.
